Aerospike Privacy Policy

Effective Date: November 26, 2025

This Privacy Policy (“Privacy Policy” or “Policy”) describes how your Personal Data is collected, used, and shared by Aerospike, Inc. (“Aerospike,” “we,” “us” or “our”), as well as the rights and choices individuals may have regarding such Personal Data. “Personal Data” is information that identifies you as an individual or relates to an identifiable individual and also includes information referred to as “personally identifiable information” or “Personal Data” under applicable data privacy laws, rules or regulations.

Aerospike provides data solutions for customers of any scale. In the ordinary course of providing our products and services, we may process data which consists of or contains Personal Data about you on behalf of our customers. If we process your Personal Data on behalf of one of our customers, the customer’s privacy policy or other agreement between the customer and you or your organization, and not this Privacy Policy, will apply to the processing of Personal Data about you. In such instances, we encourage you to contact the customer on whose behalf we process Personal Data, for any questions about their privacy practices. 

This Privacy Policy does not cover the practices of companies we don’t own or control or people we don’t manage.

Our Collection, Use, and Disclosure of Personal Data

Sources of Personal Data

We may collect Personal Data from the following sources: 


  • Information Collected Directly. We collect Personal Data when you engage with Aerospike or its service providers directly, such as when registering for a service, requesting information from us, or when you contact us or otherwise voluntarily provide information to us. 

  • Information Automatically Collected or Derived. Aerospike may also derive or automatically collect information, which may be considered Personal Data, including related to you and your use of our services and our website. This may include data collected via cookies or other similar technologies. See the Cookies, Targeting, and Analytics section below for more information.

  • Other Sources of Information. In addition, Aerospike may also obtain Personal Data about you from third parties and other sources, such as:

  • Vendors who analyze how you interact and engage with the services, or third parties may help us provide you with customer support. We may use vendors, such as data brokers, to obtain information to generate leads and create profiles.

  • Advertising partners who assist us with marketing or promotional services related to how you interact with our websites, applications, products, services, advertisements or communications.

Our Purposes for Processing Personal Data

Although the purposes for which we may process Personal Data will vary depending upon the circumstances, generally, we may use the above categories of Personal Data for the following business and commercial purposes:

  • Providing, Customizing and Improving Our Services: Providing you with the products, services or information you request; meeting or fulfilling the reason you provided the information to us; providing support and assistance for our services; improving our services, including testing, research, internal analytics and product development; personalizing our services, website content and communications based on your preferences.

  • Marketing our Services. Marketing and promoting the services, including interest-based or online behavioral advertising.

  • Corresponding with You. To communicate with you about our products and services, including sending you notices and alerts, and responding to your requests. 

  • Improving and Optimizing our Website. For example, by generating analytics about how our customers browse and interact with the website, and screen for potential risk and fraud.

  • Meeting Legal Requirements and Enforcing Legal Terms. We may disclose Personal Data to comply with the law or legal proceedings pursuant to applicable statutes and regulations in response to subpoenas, judicially signed court orders, warrants or other lawful requests including responding to national security or law enforcement.

  • With your consent or as otherwise disclosed at the time of collection.

We “share” Personal Data for cross-context behavioral advertising or targeted advertising purposes but do not otherwise “sell” Personal Data, as such terms are defined by applicable laws. We do not knowingly “sell” or “share” Personal Data of minors under 16 years of age.


We do not collect sensitive Personal Data, as defined by applicable laws.

How We Disclose Personal Data

We disclose Personal Data to the following categories of third parties for our business and commercial purposes:

  • Service Providers who help us provide our services or perform business functions on our behalf, including hosting, technology and communication providers, security and fraud prevention consultants, support and customer service vendors, and product fulfillment and delivery providers.

  • Affiliates and subsidiaries for certain purposes described above.

  • Advertising Providers who help us market our services and provide you with other offers that may be of interest to you, including advertisers, ad agencies, and advertising technology companies.

  • Analytics Partners who conduct analytics on web traffic or usage of our services.

  • Our advisors, including our lawyers, accountants, and auditors who provide services to Aerospike.

  • Government entities, regulators, or pursuant to legal process, including in response to a subpoena, court order, or similar legal process or to protect or defend our rights or those of others;

  • Business transfers, including in the event of a merger, reorganization, bankruptcy, or similar corporate restructuring activity; 

  • Parties You Authorize, Access or Authenticate, such as social media services, other users; and 

  • With your consent or as otherwise disclosed at the time of collection or sharing.

Aggregate And De-Identified Data

We may also collect, use and disclose aggregate and de-identified data without limitation. Where we use, disclose or process de-identified data, we will maintain and use the information in de-identified form and not to attempt to reidentify the information, except as permitted by applicable privacy laws.

Cookies, Targeting, and Analytics

We and other authorized third parties may collect information about your use of our website and other nonaffiliated websites over time through the use of cookies and other similar technologies. 

We may also work with third-party advertising networks and advertising providers parties who serve ads on our behalf and who collect information about visitors to our websites and other websites and apps over time. U.S. visitors may visit the Digital Advertising Alliance’s Webchoices tool here to learn how to opt out of such interest based advertising on websites by companies participating in this program. Visitors from the EU and UK may visit the European Interactive Digital Advertising Alliance’s Your Online Choices tool here. Opting out of interest-based advertisements does not eliminate all advertisements. The advertisements will still appear but may no longer be relevant to your interests. 

We work with third parties, including Google Analytics, to understand how individuals use and interact with the websites, improve the performance of the websites, and for analytics purposes. To learn more about Google Analytics, please refer to www.google.com/policies/privacy/partners, and to opt out of Google Analytics, visit tools.google.com/dlpage/gaoptout. 

You may also choose which cookies to allow on our website by using the “Update cookie preferences” link in the footer of our website. Depending on your browser, you may disable cookies in your browser settings. Remember, your cookie preferences and browser settings are specific to each device you use, and you will have to renew your cookie preferences for each of your devices or browsers.

If you choose to refuse all cookies, some of the features of our website may not function as intended.

Data Retention

We retain Personal Data about you for as long as necessary to provide you with our Services or to fulfill the business or commercial purposes for collecting your Personal Data and for an additional period of time as necessary to comply with our legal obligations, resolve disputes, maintain appropriate business records, and enforce our agreements. When establishing a retention period for specific categories of data, we consider who we collected the data from, our need for the Personal Data, why we collected the Personal Data, the sensitivity of the Personal Data, the length of time we have an ongoing relationship with you or your employer and provide our services to you or your employer, whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of transactions for a certain period of time before we can delete them), and whether retention is advisable considering our legal position (such as, for statutes of limitations, litigation, or regulatory investigations).

California Privacy Rights

If you are a California resident, you have the rights set forth in this section, subject to certain exceptions and limitations. 

  • Know or Access: You may have the right to know and access the Personal Data, we have collected about you, including the categories of Personal Data collected, the categories of sources from which the Personal Data is collected, the business or commercial purpose for collecting, selling, or sharing Personal Data, the categories of third parties to whom we disclose Personal Data, and the specific pieces of Personal Data we have collected about you.

  • Delete. You may have the right to request we delete the Personal Data we have collected about you.

  • Correct. You have the right to request we correct inaccurate Personal Data we maintain about you.

  • Opt Out of “Sharing” or “Selling” of Personal Data: You can opt out of “sharing” for cross-context behavioral advertising purposes. We do not otherwise “sell” Personal Information.

  • Non-Discrimination: We do not discriminate against individuals who exercise any of their rights described in this Privacy Policy.

  • Shine The Light: If you are a California resident, we will not disclose your Personal Data to third parties for their own direct marketing purposes, if you have exercised your right to opt-out of such disclosures. To exercise this opt-out right, please contact us at privacy@aerospike.com.

To the extent required by applicable law, we will honor an opt-out preference signal recognized by Aerospike, such as the Global Privacy Control, as a valid request to opt out of the sale or sharing of Personal Data. The signal issued by the control must be initiated by your browser and applies to the specific device and browser you use at the time you cast the signal. 

In some instances, we will need to verify your identity before honoring your privacy rights request. At a minimum, we will request you name, contact information (such as email address or phone number), and your relationship with use. 

You may also authorize an agent to exercise your rights on your behalf. To do so, you may ask that you provide that authorized agent written and signed permission to submit such request or demonstrate power of attorney. 

Third-Party Links and Services

We may offer links to or from our websites or online services as well as to websites, services, and resources operated by third parties. We are not responsible for the privacy practices, content or policies of websites operated by third parties and encourage you to review their privacy and information sharing practices before providing any information.

Additional Information for European Union and United Kingdom Individuals

If you are a resident of the European Union (“EU”), United Kingdom (“UK”), Lichtenstein, Norway or Iceland, you may have additional rights under the EU or UK General Data Protection Regulation (the “GDPR”) with respect to your Personal Data, as outlined below.

For this section, we use the terms “Personal Data” and “processing” as they are defined in the GDPR, but “Personal Data” generally means information that can be used to individually identify a person, and “processing” generally covers actions that can be performed in connection with data such as collection, use, storage and disclosure. Aerospike will be the controller of your Personal Data processed in connection with our services.

If there are any conflicts between this this section and any other provision of this Privacy Policy, the policy or portion that is more protective of Personal Data shall control to the extent of such conflict. If you have any questions about this section or whether any of the following applies to you, please contact us at privacy@aerospike.com. Note that we may also process Personal Data of our customers’ end users or employees in connection with our provision of certain services to customers, in which case we are the processor of Personal Data. If we are the processor of your Personal Data (i.e., not the controller), please contact the controller party in the first instance to address your rights with respect to such data.

Personal Data Use and Processing Grounds

The “Our Commercial or Business Purposes for Collecting Personal Data” section above explains how we use your Personal Data.

We will only process your Personal Data if we have a lawful basis for doing so. Lawful bases for processing include consent, contractual necessity and our “legitimate interests” or the legitimate interest of others, as further described below.

Contractual Necessity: We process the following categories of Personal Data as a matter of “contractual necessity”, meaning that we need to process the data to perform under our Terms of Use with you, which enables us to provide you with our services. When we process data due to contractual necessity, failure to provide such Personal Data will result in your inability to use some or all portions of our services that require such data.

  • Profile or Contact Data

Legitimate Interest: We process the following categories of Personal Data when we believe it furthers the legitimate interest of us or third parties:

  • Profile or Contact Data

  • Social Network Data

  • We may also de-identify or anonymize Personal Data to further our legitimate interests.

Examples of these legitimate interests include (as described in more detail above):

  • Providing, customizing and improving our services.

  • Meeting legal requirements and enforcing legal terms.

  • Completing corporate transactions.

Consent: In some cases, we process Personal Data based on the consent you expressly grant to us at the time we collect such data. When we process Personal Data based on your consent, it will be expressly indicated to you at the point and time of collection.

Other Processing Grounds: From time to time we may also need to process Personal Data to comply with a legal obligation, if it is necessary to protect the vital interests of you or other data subjects, or if it is necessary for a task carried out in the public interest.

EU Data Subject Rights

You have certain rights with respect to your Personal Data, including those set forth below. For more information about these rights, or to submit a request, please email us at privacy@aerospike.com. Please note that in some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it is not required by law, but in those circumstances, we will still respond to notify you of such a decision. In some cases, we may also need you to provide us with additional information, which may include Personal Data, if necessary to verify your identity and the nature of your request.

  • Access

You can request more information about the Personal Data we hold about you and request a copy of such Personal Data.

  • Rectification

If you believe that any Personal Data we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data.

  • Erasure

You can request that we erase some or all of your Personal Data from our systems.

  • Withdrawal of Consent

If we are processing your Personal Data based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time. Please note, however, that if you exercise this right, you may have to then provide express consent on a case-by-case basis for the use or disclosure of certain of your Personal Data, if such use or disclosure is necessary to enable you to utilize some or all of our Services.

  • Portability

You can ask for a copy of your Personal Data in a machine-readable format. You can also request that we transmit the data to another controller where technically feasible.

  • Objection

You can contact us to let us know that you object to the further use or disclosure of your Personal Data for certain purposes, such as for direct marketing purposes.

  • Restriction of Processing

You can ask us to restrict further processing of your Personal Data.

  • Right to File Complaint

You have the right to lodge a complaint about Aerospike’s practices with respect to your Personal Data with the supervisory authority of your country or EU Member State. A list of Supervisory Authorities is available here:

Transfers of Personal Data

Our services are hosted and operated in the United States (“U.S.”) through Aerospike and its service providers, and if you do not reside in the U.S., laws in the U.S. may differ from the laws where you reside. By using our services, you acknowledge that any Personal Data about you, regardless of whether provided by you or obtained from a third party, is being provided to Aerospike in the U.S. and will be hosted on U.S. servers, and you authorize Aerospike to transfer, store and process your information to and in the U.S., and possibly other countries. In some circumstances, your Personal Data may be transferred to the U.S. pursuant to a data processing agreement incorporating standard data protection clauses.

Changes

The “Effective Date” at the top of this Policy indicates when this Policy was last updated. We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
